§1 Scope of Application

These General Terms and Conditions (GTC) apply to all contracts concluded between Sharma & Singh GbR (hereinafter "FOKUS" or "Provider") and the customer (hereinafter "Customer") through our website getfokus.de.

Deviating, conflicting, or supplementary terms and conditions of the Customer shall not become part of the contract unless the Provider expressly agrees to their validity in writing.

§3 Contract Conclusion

  • The presentation of products on our website does not constitute a legally binding offer, but rather an invitation to place an order.
  • By clicking the "Order" button, the Customer submits a binding offer to purchase the items in the shopping cart.
  • The Provider will confirm receipt of the order by email immediately after receiving the order. This confirmation does not constitute acceptance of the order.
  • The contract is concluded when the Provider sends a separate order confirmation email or ships the goods.

§4 Services and Products

FOKUS offers the following:

  • FOKUS Device: A physical distraction-blocking device that connects to your iPhone
  • FOKUS iOS App: A mobile application that works with the device, is free with purchase, stores all data locally, and requires no account or internet connection
  • Accessories and replacement parts
  • Customer support and maintenance

§4a iOS Application Usage

By using the FOKUS iOS application, you agree to the following:

  • The app is licensed for use on your personal iOS devices
  • You are responsible for maintaining the security of your device and the data stored within the app
  • The app operates entirely offline and stores all data locally on your device
  • We do not collect, access, or store any data from the app
  • The app may be updated via the Apple App Store, and continued use implies acceptance of these terms
  • You may not reverse engineer, decompile, or attempt to extract the source code

§5 Prices and Payment

  • All prices include statutory VAT and other price components
  • Shipping costs are shown separately before checkout
  • Payment is due upon order placement unless otherwise agreed
  • Accepted payment methods include credit card, PayPal, and bank transfer
  • In the event of default in payment, statutory interest may be charged

§6 Delivery

  • Delivery times are indicated on product pages and during checkout
  • Delivery is made to the specified address
  • Risk of loss:
    • For entrepreneurs: upon handover to the shipping company
    • For consumers: upon delivery
  • Partial deliveries are permissible if reasonable

§7 Right of Withdrawal

Consumers have the right to withdraw from this contract within 14 days without giving any reason.

Withdrawal Period

The withdrawal period expires 14 days after you (or a third party designated by you) receive the goods.

To exercise the right of withdrawal, you must notify us via letter or email.

Consequences of Withdrawal

If you withdraw, we will reimburse all payments received, including standard delivery costs (excluding additional costs for non-standard delivery), within 14 days of notification.

§8 Warranty

  • Statutory warranty rights apply
  • Warranty period:
    • Consumers: 24 months
    • Entrepreneurs: 12 months
  • Customers must inspect goods and report defects in writing

§9 Liability

  • Unlimited liability for intent and gross negligence
  • For slight negligence: liability applies only to essential contractual obligations and is limited to foreseeable damage
  • No limitation applies for injury to life, body, or health
  • Applies also to employees, representatives, and agents

We process your personal data in accordance with our privacy policy. By using our services, you consent to this processing.

§11 Applicable Law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection laws remain unaffected.

§12 Severability Clause

If any provision is invalid or unenforceable, the remaining provisions remain valid. The invalid provision will be replaced with one that most closely reflects its intended purpose.

§13 Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
